Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 * * * *

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Odyssey Lacrosse Events (“OLE”) has put in place preventative measures to reduce the spread of COVID-19; however, OLE cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending OLE programs could increase your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I ACKNOWLEDGE the contagious nature of COVID-19 and VOLUNTARILY ASSUME THE RISK that my child(ren) and I may be exposed to or infected by COVID-19 by participating in or attending OLE programed events and that such exposure or infection may result in personal injury, illness, permanent disability, and death to myself, my spouse, guests, child(ren), unborn child, or relatives. I understand that the risk of becoming exposed to or infected by COVID-19 while participating in a OLE program may result from the actions, omissions, or negligence of myself and others, including, but not limited to, OLE employees, volunteers, and program participants and their families.

I AGREE AND UNDERSTAND AND VOLUNTARILY ACCEPT AND AGREE TO ASSUME ALL of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s participation at an OLE program. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless OLE, its employees, agents, and representatives, of and from any OLE program, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. Further, I UNDERSTAND AND AGREE that this release includes any Claims based on the actions, omissions, or negligence of OLE, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any OLE program or related event.

Liability Waiver *

LIABILITY WAIVER: By checking this box you agree that you have read, understand and agree to the following waiver of liability. Specifically, you agree that you are a guest or participant at Odyssey Lacrosse Events (OLE) events and activities. Many OLE activities are conducted at the Evergreen Sportsplex which is located at 19623 Evergreen Mills Road, Leesburg, VA 20175. Evergreen Sportsplex is owned by Evergreen Sports Complex, LLC and its main business is to provide a facility for various sports activities for both adults and children. From time to time it is possible for a participant to suffer athletic or other injuries relating to his/her participation in OLE activities. By checking the box, you hereby release and hold harmless OLE and their Owners, Licensees, Employees, and other Agents from all claims arising from your participation in OLE activities and/or presence at the Evergreen Sportsplex. This includes, but is not limited to, personal injury, accidents, and other unintentional causes. Your participation in OLE activities and your entrance and use of the Evergreen Sportsplex means that you accept this responsibility. If you have any medical conditions or situations that might reasonably affect your participation, it is your responsibility to notify OLE management, who will have the sole discretion to deny participation, based upon this information. If you are a minor under the age of 18, your parent, legal guardian, or caregiver must give consent by execution of this WAIVER for you to participate. It is the responsibility of the guest, participant, or visitor to execute this WAIVER prior to participating in any activity. Failure to do so shall imply that you consent to the terms and conditions of the WAIVER.
